DECATUR, GA, January ••, 2026: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “Protecting The Healthy Spouse When The Other Has Dementia,” in which Ms. Pawley highlights Community-Spouse Rules, Income Allowances, and Asset Protection Strategies.

“When one spouse is diagnosed with dementia,” Pawley writes, “the emotional and financial toll on the healthy spouse can be overwhelming.” She adds, “Long-term care is expensive and without planning in place, the healthy spouse may face financial hardship. Fortunately,” Pawley explains, “Medicaid and elder law provide protections designed to prevent the healthy spouse, often called the community spouse, from becoming impoverished while ensuring the ill spouse receives necessary care.”

As Pawley points out, “The cornerstone of this protection comes in the form of community-spouse rules.” She elaborates. “Under Medicaid, spouses are treated differently from single applicants. While the spouse with dementia (identified as the institutionalized spouse) must meet strict income and asset limits to qualify for Medicaid long-term care benefits, the community spouse is allowed to retain a designated share of the couple’s assets. This is known as the Community Spouse Resource Allowance (CSRA). The CSRA enables the healthy spouse to keep a portion of savings, investments, and other countable resources rather than spending everything down on care.”

Pawley goes on to explain how Income Allowances and Asset Protection Strategies, “when used appropriately and with professional guidance, play a critical role in protection the healthy spouse.”
