DECATUR, GA, October 29, 2025: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitledSafeguarding the Family Home Through Trusts, Life Estates, and Asset-Protection Tools” in which Ms. Pawley reviews several estate planning tools that lets homeowners avoid probate and protect their greatest asset for their heirs.

“For so many families,” Pawley writes, “home is more than merely a physical structure.” She continues, “Home represents both financial security and emotional legacy. However, the potential need for long-term health care can place your home at risk if proper planning is not in place.”  “Fortunately,” Pawley states, “asset-protection strategies such as trusts, life estates, and other legal tools can help safeguard your family home, ensuring it remains within the family even if future care costs arise.”

As Pawley points out, “One common estate planning approach is the use of an irrevocable trust, through which you transfer ownership of your home into a trust. Then the property is no longer considered part of your individual personal assets.” Pawley emphasizes, “This means it may be protected from being used to pay for long-term care costs or nursing home expenses.” There is one caveat according to Pawley. She cautions, “However, the transfer into the trust must occur at least five years before applying for Medicaid to avoid penalties under their strict look-back rules.”

Pawley also discusses a life estate, transfer-on-death deeds and homestead exemptions.
