DECATUR, GA, March 25, 2022: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “Spare Your Family: Avoid Probate For Solely Owned Out-of-State Real Estate,” in which Ms. Pawley acknowledges the importance of making the avoidance of any probate a priority.

“Owning a home in another state from your primary residence is a luxury that more and more people enjoy,” Pawley states. She adds, “Whether a timeshare, vacation home or deeded family property, this luxury is too often the source of additional expenses and headaches for family members after the death of the loved one who had such a property. That’s because the family then must go through a second or what is known as a multi-state or ancillary probate, which involves hiring an attorney in that state.”

As Pawley points out, “Probate is a headache everyone wants to avoid.” She emphasizes, “Having to go through probate in another state is even worse.” According to Pawley, “The good news though is that all probate can be avoided if you make the avoidance of all probate a priority. The best way to avoid probate is to make sure you discuss all property owned solely or jointly when establishing your estate and asset protection plan with your attorney.”

Shannon earned her undergraduate degree at North Carolina Wesleyan College and pursued a law degree from Michigan State University College of Law. After obtaining her law degree and becoming a licensed attorney in Michigan, she continued her educational pursuit by acquiring a LL.M. (Master of Law) in Taxation from Wayne State University.
