Dr. Brad Levine, Orlando Chiropractor and owner at Workflow Employer Services releases new article outlining potential legal issues a DOT physical provider could deal with regarding the DOT physical exam.
Altamonte Springs, FL — October 10, 2016 — Workflow Employer Services owner and Orlando area chiropractor Dr. Brad Levine recently published a new article on his website “DOT Physical Providers Beware: Legal Considerations for DOT Physical Exam Providers & DOT Physical Exam Locations.”
In this article, Dr. Levine covers the way DOT physical providers may get drawn into legal issues. As he says:
“Cases are not often brought against DOT medical exam providers. With the new requirements, this should be even less. However, if you are a DOT physical provider, you do need to be aware of these legal considerations to be sure you protect yourself as much as possible, while serving your patients.”
From there, Dr. Levine goes on to outline the four most common types of legal situations where the DOT physical provider may find him or herself playing a role. These include negligence, third party suits, employer suits, and disability discrimination cases. In each instance, the provider is brought in when it is deemed his or her actions may have had a negative impact, through breach of duty, in an injury or accident.
He also cautions:
“The best DOT provider will always do his or her job to the best of their ability. This includes remaining within safe legal bounds. Thus, the best course of action is to know and follow the DOT physical guides thoroughly and completely. If this is done, the legal considerations will always remain, but should be of little concern.”
