The Estate & Asset Protection Law Firm Owner, Shannon Pawley, Writes About The Hidden Costs Of Not Having An Estate Plan

Shannon Pawley, The Estate & Asset Protection Law Firm Owner, focuses on what happens to families when there is no estate plan in place when tragedy strikes.

DECATUR, GA, February 23, 2026: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitledWhat Really Happens If You Pass Away or Become Incapacitated Without an Estate Plan.” Ms. Pawley highlights specific costly events that typically occur when people do nothing to prepare for sudden incapacity or death.

Pawley states, “I often write about how common it is for people to put off creating an estate plan. And here I go again.”

“I know that life is busy,” Pawley states, continuing, “and that the topic feels uncomfortable.” She adds, “When you are young and healthy, doing nothing about an estate plan seems harmless. But take this in: Based on studies conducted during the COVID-19 pandemic, roughly 1 in 5 Americans who died did not have an estate plan in place (ecaring.com). The United States reported over 1.2 million deaths from COVID-19, suggesting that hundreds of thousands of families were left to deal with intestate estates (dying without a will or estate plan).”

“So,” Pawley asks for her readers, “what exactly happens if you become incapacitated without the proper documents in place?” She emphasizes, “Your loved ones may have to seek guardianship through the court.” She explains, “That means a judge controls your medical and financial decisions. The process can be expensive, public, and emotionally draining.” She adds, “It often requires medical evidence, attorney involvement, and ongoing court supervision.”

Pawley also states that bank accounts can be frozen. She writes, “Even a spouse or adult child may not be able to access funds to pay the mortgage, utilities, or medical bills.”
